Ontario Regulation 209/01 and your home

Ontario Regulation 209/01, under the Technical Standards and Safety Act, covers elevating devices including stair chair lifts. The Regulation does not apply to elevating devices in or in connection with private dwelling houses used exclusively by the occupants and their guests, unless the owner requests in writing that it apply. It also does not apply to lifts for persons with physical disabilities that rise 600 mm or less and are not accessible to the general public. TSSA licenses elevating-device contractors and mechanics for the devices its Regulation covers. TSSA publishes a questionnaire to determine whether premises count as a private dwelling house.

The City's permit list includes structural alterations, and a lift that requires a new floor or wall opening may involve structural work, so ask the City's Building Code Services whether your installation requires a permit before work begins.

Ask each contractor to give you a written quote that shows the cost of the unit, the installation labour, any structural or finishing work, and whether permits are included if the City determines one is needed. Under the Consumer Protection Act, 2002, if the agreement is made somewhere other than the contractor's business premises, such as your home, it must be in writing and delivered to you, and you can cancel within 10 days after you receive the written copy. If any agreement includes an estimate, the contractor cannot charge more than 10 per cent above it.

Under the Construction Act, an owner must hold back 10 per cent of the price as work is supplied; ask a lawyer about when it is safe to release that amount on a larger job.

Before you commit to a contractor, ask them to walk you through exactly what happens at the top and bottom of your stair, and what finishing work is included in the price.
